Miphen Terms of Service

Version 1.1 · Effective October 10, 2026

These terms are an agreement between you and Miphen, Inc. ("Miphen," "we," "us") for using miphen.com and Miph, our AI companion you talk to by text and phone call. By signing up or using Miph, you agree to these terms, our Privacy Policy, our Text and Call Terms and, during the beta, our Beta Terms.

Please read section 19. It requires you to resolve most disputes with us in individual arbitration, not in court or as part of a class action, unless you opt out within 30 days.

1. Who can use Miph

You must be 18 or older and live in the United States. During the beta, Miph is available only in California. You need a mobile phone number that is yours. Give us accurate information, and keep one account. If we learn that a user is under 18, we close the account.

2. What Miph is

Miph is an AI. It is not a person, and every text and call from Miph is generated by artificial intelligence. Miph helps you reflect on yourself and your relationships, using what you tell it and a birth chart calculated from your birth details. Miph remembers your conversations so it can notice patterns over time. Miph can be wrong, can misunderstand you, and can say things that are incomplete or untrue.

3. Not professional advice, not emergency help

Miph is not therapy, counseling, medical care, or legal, financial or other professional advice, and it does not replace any of them. Don't rely on Miph for decisions about your health, safety, money or legal rights; talk to a qualified professional.

Miph is not an emergency service and can't call for help for you. If you are in danger, call 911. If you're thinking about suicide or hurting yourself, call or text 988, or text HOME to 741741. See our Safety page.

4. Insights and birth charts

Miph's insights, including anything drawn from your birth chart, are for self-reflection and entertainment. They're interpretations, not facts or predictions, and they're not professional advice. Patterns Miph notices are possibilities to consider, not conclusions about you or anyone else. You decide what to do with them.

5. Your account

Your phone number is how Miph knows you, so keep your phone secure. Login links we text you work once and expire after 15 minutes; don't forward them. Miph may ask you to confirm it's you before discussing your history. If you lose or change your number, tell us at support@miphen.com right away. You're responsible for activity on your account that results from not keeping your phone or links secure.

6. Texts and calls

Our Text and Call Terms cover how we text and call you, how often, and how to stop. Reply STOP to any text to stop all texts and calls.

7. Your content

"Your content" means what you send Miph: messages, call conversations, birth details, and information about yourself and other people. You keep ownership of it. You give Miphen and its successors a license to store, copy, process and use your content to run, protect and improve Miph, and, unless you turn it off in settings, to develop and train AI models and products, as described in our Privacy Policy. This license ends when your content is deleted, except for copies we must keep by law and de-identified information.

When you tell Miph about other people, share only what you have a right to share, and don't use Miph to collect information about anyone to harm, track or expose them.

8. Acceptable use

Don't use Miph to:

  • break the law or help anyone else break it;
  • harass, threaten, stalk, monitor or harm anyone, or plan to;
  • get instructions for self-harm, violence, weapons or other dangerous acts, or try to trick Miph into giving them;
  • make decisions about someone else's job, housing, credit, insurance or legal rights;
  • create sexual content involving minors, or any sexually explicit content;
  • impersonate anyone, or let someone under 18 use your account;
  • send spam, malware, or automated or bulk messages;
  • copy, scrape, reverse engineer or overload Miph or miphen.com, or use Miph's output to build a competing AI product.

We may limit, suspend or close accounts that break these rules or put anyone at risk.

9. Connections and events

Connections. If you connect with another Miphen user (for example, by QR code), you choose what they can see. Don't share another person's private information through a connection.

Events. Miphen may host in-person events. Taking part is voluntary and at your own risk. Follow the host's instructions and treat others with respect. Don't record or photograph other attendees without their permission; Miphen does not record the room. We may ask anyone to leave an event or ban them from future events.

10. Price, the beta and paid plans

Miph is free during the beta. If we introduce paid plans, we will show you the price, what's included, how often you'll be charged and how to cancel before you buy, and we'll charge you only after you agree to those terms separately. You'll be able to cancel online at any time. Those plan terms will be added to these terms before any charge.

11. Changes to Miph

Miph is new and will change. We may add, change or remove features, limits or the service itself. If we shut Miph down, we'll tell you at least 30 days ahead when we can and give you a way to download your data.

12. Feedback

If you send us ideas or feedback, we can use them without paying you or owing you anything.

13. Our property

Miph, miphen.com, our software, design, names and content belong to Miphen or our licensors. We give you a personal, non-transferable, revocable right to use Miph under these terms. Nothing else is licensed to you.

14. Ending your use

You can stop using Miph and delete your account at any time in settings or by emailing privacy@miphen.com. We may suspend or close your account if you break these terms, if it's needed to protect you or others, or if the law requires it. Sections 7 (for content we keep), 12, 13, 15 to 19 and 21 survive.

15. Disclaimers

To the fullest extent the law allows, Miph is provided "as is" and "as available," without warranties of any kind, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We don't promise Miph will be uninterrupted, error-free, or that texts and calls will always be delivered.

16. Limits on our liability

To the fullest extent the law allows, Miphen is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from Miph or these terms. Our total liability for all claims is limited to the greater of $100 or what you paid us in the 12 months before the claim. These limits don't apply where the law doesn't allow them, including for gross negligence, willful misconduct or personal injury caused by our negligence.

17. Your responsibility

If you break these terms or the law while using Miph, and someone makes a claim against Miphen because of it, you'll cover our reasonable costs of that claim, to the extent the law allows.

18. Governing law

The Federal Arbitration Act governs section 19. Otherwise, California law governs these terms, without regard to conflict-of-law rules. Any dispute that isn't arbitrated will be heard in the state or federal courts in San Mateo County, California, and you and Miphen agree to those courts' jurisdiction.

19. ARBITRATION AGREEMENT AND CLASS ACTION WAIVER

a. Try to resolve it first. Before starting arbitration or a lawsuit, email admin@miphen.com with your name, phone number, a description of the problem and what you want. We'll do the same to you. Both sides will try in good faith to resolve it for 60 days.

b. Arbitration. If it isn't resolved, you and Miphen agree that any dispute arising from Miph or these terms will be decided by binding individual arbitration, not in court. This includes disputes about whether this arbitration agreement applies. The arbitration will be run by JAMS under its Streamlined Arbitration Rules and Consumer Minimum Standards, before one arbitrator, by video or in the county where you live. The arbitrator can award the same individual relief a court could.

c. Costs. You pay no more than the filing fee you would pay in court, and Miphen pays the rest of the JAMS and arbitrator fees. Miphen will pay its fees within 30 days of receiving each invoice.

d. Exceptions. Either of us may bring an individual claim in small claims court. Either of us may go to court to stop infringement or misuse of intellectual property. A claim for public injunctive relief (an order protecting the general public) will be decided by a court after the individual arbitration ends, and is paused until then.

e. No class actions. You and Miphen may bring claims only individually, not as a plaintiff or class member in a class, collective or representative action. The arbitrator can't combine claims of different people. If this paragraph is found unenforceable for a claim, that claim goes to court, not arbitration.

f. Mass filings. If 25 or more similar claims are filed by or with the help of the same lawyers or coordinated group, the first 10 go forward as test cases in arbitration, and the rest wait. Afterward, the remaining claims are filed in batches of up to 50, and both sides will try to resolve them. Time limits for waiting claims are paused while they wait.

g. Opt out. You can reject this section 19 by emailing admin@miphen.com within 30 days of first accepting these terms, with your name, phone number and the words "I opt out of arbitration." Opting out doesn't affect the rest of these terms.

h. Changes. If we change this section, the change won't apply to a dispute you've already notified us of.

20. Changes to these terms

We'll post any new version here with a new effective date. For important changes we'll tell you by text or in the web app at least 15 days before they take effect, and where the law requires it we'll ask you to accept them. If you don't agree, you can delete your account.

21. General

These terms, with the documents they link to, are the whole agreement between us about Miph. If any part is unenforceable, the rest still applies. Not enforcing a term isn't a waiver. You can't transfer these terms; we can transfer them in a merger, acquisition or sale of assets. We send notices by text, email or in the web app.
